Welcome to VMK HARS! By accessing our website (https://vmkhars.com/******) and using our video editing and motion graphics services, you agree to the following Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

VMK HARS reserves the right to update these terms at any time without prior notice. It is the client’s responsibility to review them periodically.

1. Services Offered

VMK HARS specializes in professional video editing and motion graphics, including but not limited to:

• Video Editing (Trimming, Transitions, Color Correction, Effects, and Enhancements)

• Motion Graphics  (Logo Animations, Infographics, Explainer Videos)

• Audio Enhancements (Noise Reduction, Sound Mixing, Background Music)

• Video Formatting (Optimization for YouTube, Social Media, and other platforms)

Each service is customized based on the client’s specifications.

2. Pricing and Payments

• The cost of video editing projects will be determined based on the complexity, duration, and client requirements.

• Full or partial payment must be made before the project starts.

• Accepted payment methods: [Bank Transfer, UPI, PayPal, etc.].

• Late payments may cause project delays.

• VMK HARS reserves the right to modify pricing at any time without prior notice.

• Regardless of the actual duration of the project, if the final time is less than one minute, the client will be billed for the minimum charge equivalent to one minute 

3. Project Turnaround Time

• The estimated delivery time for video editing projects will be provided before project initiation.

• Urgent or same-day delivery requests will incur an additional charge.

• Delays caused by the client (e.g., late submission of materials, unclear instructions) are not our responsibility.

4. Revisions Policy

• Up to 2 minor revisions are allowed per project free of charge.

• Major changes (e.g., replacing entire clips, changing voiceovers, re-editing large portions) will be charged additionally.

• Revision requests must be made within 24 hours of receiving the first draft.

• Any revision requests beyond the agreed limit or timeframe will be charged extra. 

5. Refund and Cancellation Policy

• Refunds will only be provided if VMK HARS fails to deliver the agreed service.

• Cancellations before the editing process starts will be eligible for a partial refund.

• Once editing work has started, no refunds will be provided.

• If a client approves a script/concept and later rejects the final edited video, the full payment must still be made.

• Unused project credits (if any) cannot be transferred or refunded.

6. Client Responsibilities

• The client must provide all necessary raw footage, logos, images, audio files, and other assets required for the project.

• Clients must ensure they have the rights to all materials submitted for editing.

• VMK HARS is not responsible for any copyright issues that may arise due to client-submitted content.

• The client must provide clear and detailed instructions before the project begins to avoid miscommunication and rework.

7. Intellectual Property and Copyright

• The final edited video belongs to the client after full payment.

• VMK HARS reserves the right to use completed projects in its portfolio unless the client explicitly requests otherwise.

• Clients cannot claim VMK HARS as an editor for any videos edited elsewhere.

• If a client shares an unfinished project, draft, or preview publicly without permission, VMK HARS has the right to terminate the service.

• We primarily use copyright-free stock images and videos; however, in certain instances—such as with memes, movie clips, sound effects, and specific images or videos—copyright concerns may arise. These cases are often considered a grey area, which has been commonly used within the editing industry for many years. Please note that VMKhars is not responsible for any copyright issues related to the content created.

8. Unethical Practices & Prohibited Content

• VMK HARS will not edit or produce content that contains:

  • Hate speech, violence, or discrimination

  • Pornographic or sexually explicit material

  • Fake engagement (e.g., artificially boosting views, likes, or subscribers)

  • Illegal or misleading content

• If such content is found in the submitted raw footage, the project will be immediately canceled without a refund.

9. Data Privacy and Security

• VMK HARS prioritizes client privacy and confidentiality.

• All raw footage, project files, and final videos will be kept secure and will not be shared with third parties.

• Clients must store their final videos securely, as VMK HARS is not responsible for lost files after project completion.

• Backup requests for past projects may incur an additional fee.

10. Limitations of Liability

• VMK HARS does not guarantee an increase in engagement, views, or revenue after video editing.

• We are not responsible for any loss or damage caused by third-party platforms (e.g., YouTube strikes, copyright claims).

• The client is solely responsible for ensuring their content follows YouTube and other platform policies.

• VMK HARS is not liable for any loss of revenue, reputation, or legal action resulting from the use of our services.

11. Termination of Services

VMK HARS reserves the right to terminate services without a refund if:

• A client violates these Terms and Conditions.

• There is any form of abuse, harassment, or disrespectful communication.

• The project is deemed to involve unethical or illegal content.

12. Dispute Resolution & Governing Law

• All disputes will be attempted to be resolved through mutual discussion.

• If unresolved, legal matters will be handled in the courts of Tamil Nadu, India.

• These Terms and Conditions are governed by the laws of India.
